Welcome to Alphyn. By accessing or using our website, application, or any associated services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before using the Service.

1. Service Description

Alphyn is a cryptocurrency sentiment analysis platform that aggregates publicly available data from sources such as CoinGecko, StockTwits, and social media to generate sentiment scores, trend signals, and alerts delivered via Telegram and our web dashboard.

Alphyn is a data and analytics tool only. It does not provide financial advice, investment recommendations, or trading signals. All information provided through the Service is for informational and educational purposes only. You should always conduct your own research and consult a qualified financial advisor before making any investment decisions.

2. Account Creation and Eligibility

To use certain features of the Service, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Accept responsibility for all activity that occurs under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 18 years of age to create an account and use the Service. By creating an account, you represent and warrant that you meet this age requirement.

3. Free and Pro Subscriptions

Alphyn offers two tiers of access:

• Free Plan: Provides limited access to sentiment data and basic features at no cost.
• Pro Plan: Priced at $19 per month, the Pro Plan provides full access to all features including advanced sentiment analysis, real-time Telegram alerts, and priority data updates.

Pro subscriptions are billed monthly through Stripe, our third-party payment processor. By subscribing to the Pro Plan, you authorize Alphyn to charge your payment method on a recurring monthly basis until you cancel.

Cancellation: You may cancel your Pro subscription at any time through your account settings. Upon cancellation, you will retain access to Pro features until the end of your current billing period. No refunds will be issued for partial billing periods.

Price changes: We reserve the right to modify subscription pricing. Any price changes will be communicated to you at least 30 days in advance and will take effect at the start of your next billing cycle.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party rights
• Scrape, crawl, or use automated means to extract data from the Service beyond what is provided through our intended interfaces
• Reverse engineer, decompile, or disassemble any part of the Service
• Redistribute, resell, or sublicense access to the Service or its data without written permission
• Attempt to gain unauthorized access to any part of the Service, other accounts, or connected systems
• Transmit malware, spam, or any harmful or disruptive content
• Interfere with or disrupt the integrity or performance of the Service
• Use the Service to manipulate markets or engage in any form of market abuse

5. Intellectual Property

All content, features, and functionality of the Service -- including but not limited to text, graphics, logos, icons, software, algorithms, data compilations, and design -- are the exclusive property of Alphyn and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes in accordance with these Terms. This license does not include the right to copy, modify, distribute, or create derivative works based on the Service.

6. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.

Alphyn expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free
• The sentiment data, scores, or signals will be accurate, complete, or reliable
• Any particular outcome or result will be achieved by using the Service
• Defects in the Service will be corrected

Alphyn does not provide investment advice. Cryptocurrency markets are highly volatile and speculative. Any decisions you make based on information from the Service are made entirely at your own risk.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Alphyn and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with:

• Your use of or inability to use the Service
• Any investment or trading decisions made based on information from the Service
• Unauthorized access to or alteration of your data
• Any third-party conduct on or related to the Service
• Any other matter related to the Service

In no event shall Alphyn's total cumulative liability exceed the amount you have paid to Alphyn in the twelve (12) months preceding the event giving rise to the claim.

8. Termination

We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice, including if we reasonably believe you have violated these Terms.

Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall remain in effect, including but not limited to intellectual property provisions, disclaimers, limitations of liability, and dispute resolution.

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from or related to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation between the parties.

If a dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue resolution through binding arbitration or the courts of competent jurisdiction.

10. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by updating the effective date at the top of this page and, where appropriate, by sending a notification to the email address associated with your account.

Your continued use of the Service after any changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.
